1. General
1. EscapeNet services are provided subject to Our Customer Terms which can be found at www.esc.net.au/terms or by calling 0882925200 for a copy to be posted.
2. There is no cooling off period associated with this order. By continuing you are committing to an order for service. This is NOT an enquiry; withdrawal fees may apply!
3. This document contains some important information from Our Customer Terms that we wish to emphasise to you.
4. All installation times given are approximations.
5. All services continue month by month after any initial or fixed contract period until cancelled.
6. A $55 order withdrawal fee applies if the service has not past the 'point of no return'. Full cancellation applies once the 'point of no return' has been reached.
2. NBN Telephony Related Consents
1. This service does not support Priority Assistance. If you require Priority Assistance you must not use this service.
2. There is no battery backup system provided as part of this order. Additional information can be found in our NBN Battery FAQ.
3. Irrespective of whether your NBN service has an NBN backup power supply, in the event of a power outage the internet and any telephone services provided through or by an EscapeNet NBN product will not function, this includes emergency calls to 000.
4. Your router (CPE) and telephone handsets may only operate if you have a separate backup power supply and a standard corded telephone is used.
5. This service is not designed to be used as a primary telephone service.
6. Analogue based services such as security alarms, medical alarms, fax machines, EFT, TTY, emergency call services and other voice and data services are not guaranteed to operate with this service.
3. Freedom Telephony Related Consents
1. This service does not support Priority Assistance. If you require Priority Assistance you must not use this service.
2. You must waive each and all of your Installation related Customer Service Guarantee rights in order to provision this service.
3. This service doesn't support some features like line hunt.
4. Reach Telephony Related Consents
1. This service does not support Priority Assistance. If you require Priority Assistance you must not use this service.
5. Port-in Telephony Related Consents
1. This service does not support Priority Assistance. If you require Priority Assistance you must not use this service.
2. A $10 order withdrawal fee applies if the service has past not past the point of no return.
3. A $50 urgent port-in reversal fee applies if requested.
6. VoIP Telephony Related Consents
1. This service does not support Priority Assistance. If you require Priority Assistance you must not use this service.
2. A $50 urgent port-in reversal fee applies if requested.
3. CSG must be waived for VOIP telephone services (including NAKED DSL connections), in return for heavily reduced telephone call costs.
4. The free VOIP DID included with new naked plans is provided for the local calling area of the capital city of your state.
5. Voip requires both your internet and power to be active to function correctly.
7. ADSL Terms and Conditions
1. All devices connected to the phoneline must be filtered. All filtering, including, but not limited to monitored alarm filtering is the responsibility of the end user.
2. Please allow a minimum of 7 or 14 working days for the Reach and Freedom/Naked respectively to be provisioned.
3. Telstra will automatically cancel your ADSL service when:
1. you cancel your telephone account
2. you relocate (even when taking your existing number)
3. you order a ADSL incompatible product on the line ADSL is provisioned to.
4. Any faults found to be the cause of the customer, or internal cabling will be charged an incorrect call out fee as displayed for the relevant product on our website.
5. Customers choosing either Express24 or Naked ADSL services, who are deemed to be in a multi-dwelling unit, will need to arrange, and pay, for their own cabler to complete the internal wiring at their place.
6. ADSL is an 'always on' service and once provisioned cannot be suspended by you for any time period.
7. The ADSL service is provisioned on a specified telephone line and is not be accessible at other locations.
8. Upon provision on the ADSL service other telephony products may become incompatible.
9. It is your responsibility to ensure future telephony requirements do not conflict with the ADSL service.
10. Signing and submitting an DSL application either, written or online, is deemed that the service will become active and all charges and fees pertaining to the selected DSL service will be applicable.
11. Early termination fees apply to services cancelled within their commitment periods, ranging from $99-$229 depending on the plan you sign up on. Please contact us to confirm the fee applicable to your order.
12. Cancellation of service can only be via direct submission and acknowledgement of the EscapeNet xDSL Service Cancellation Request form.
13. ADSL service orders remain active until the order is
1. deemed as unprovisionable by EscapeNet;
2. withdrawn (fees apply); or
3. provisioned.
14. Cancellation of the adsl service order may not always be possible as the service may become active prior to the processing of the cancellation
15. Monthly service fees are payable even whilst internet access is disabled for non payment.
16. Postage is not included in ADSL set up costs, delivery cost of hardware is your responsibility.
17. The speed of our Express8 is a maximum of 8Mbps/384kbp, Express24, Reach24 and Naked ADSL services are a maximum of 24Mbps/1Mbps. The exact speed will depend on the quality of your internal wiring, distance from the exchange and other physical characteristics of the line. The minimum speed for these services is 1.5Mbps/256k.
18. Both Naked and Express services are not suitable for customers who require priority assistance.
19. The Naked service is not suitable if you require a normal telephone line for uses like alarm monitoring, health monitoring, faxing etc. Furthermore emergency service numbers may not work. If you are unsure about the suitability of this service, please call our customer service officers.
20. CSG must be waived for VOIP telephone services (including NAKED DSL connections), in return for heavily reduced telephone call costs.
21. Free VOIP DID included with new naked plans are is in the local calling area of the capital city of your state.
22. Voip requires both your internet and power to be active to function correctly.
23. Express24 Free Install & Relocation Conditions
1. On your acceptance of waiving your CSG rights, EscapeNet will provide:
1. installation of your phone and adsl2+ bundle for free
2. relocation of your phone and adsl2+ bundle for $99
2. Should you choose not to waive your rights, you will need to notify us in writing and pay the full installation fee. Relocation orders must have CSG waived. Your normal fault CSG rights are not waived.
3. Relocation will trigger a contract renewal or extension. This means that if you have already partly served out your contract the extension will be 12 (if you had less than 12 months remaining) or otherwise 24 months.
24. Naked Free Install
1. Free install requires existing telephone line, otherwise $120 install fee applies.
25. Wireless 3G Terms and Conditions
1. If you have an existing billing anniversary, your 3G Wireless service will be billed on this same date. Your data usage however, will be measured from the 1st of each month. Herein referred to as your data cycle.
2. As your EscapeNet modem and SIM card are sensitive devices, a strict 10 day 'dead on arrival' return policy applies. After this time it is deemed that the device is working and that any replacement modem would be at supplied at full charge.
3. Usage is measured as the sum of sent and received data to your service. Unused usage cannot be rolled over to the following month. Excess data usage is billed at 10c/Mb
4. For a $10 fee, you may change your plan during your contract for the following data cycle.
5. If you purchase an eligible product we will provide you with our bundled pricing. In the event that you cancel the eligible product, we will change your plan to the equivalent unbundled plan.
6. An early termination fee of $300 (pro-rated) + $20 (administration) applies if you cancel your service before the end of your initial term.
7. If you cancel the Service before the minimum Term ends, you must pay back any discounts or special offers you received to sign up for that Term.
8. Your service will continue on a month to month basis after your initial term.
9. 30 days notice of cancellation is required in writing.
10. This 3G Wireless service is provided as is and does not include a service guarantee. As such, there is no 'cooling off' period included and the service does not meet any minimum specification. This includes (but is not limited to) coverage, the speed of the service and the consistent uptime of the service.
11. With any network based on radio technology, local conditions may prevent or interfere with mobile reception within coverage areas - e.g., inside concrete buildings, lift wells, basements, tunnels and road cuttings. High rise buildings may also suffer degradation of service and our coverage maps are not an indication of in-building coverage.
12. The speeds available to a particular 3G Wireless customer are affected by many factors, and actual speed rates are not guaranteed.
